Summary

By using RichmondPix, you agree to these terms. The short version: be respectful, only upload photos you own and have the right to share, don't abuse the platform, and understand that your public content may be seen and shared by others in the community. We may remove content or accounts that violate these terms.

1. Acceptance

These Terms of Service ("Terms") govern your access to and use of RichmondPix.com, including all features, content, and services provided through the platform ("Platform"). By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 13 years old to use RichmondPix. By creating an account, you confirm that you meet this requirement. If you are under 18, you confirm you have your parent or guardian's permission.

3. Your Account

You are responsible for maintaining the security of your account and password. Do not share your credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@richmondpix.com if you suspect unauthorized access.

We reserve the right to terminate accounts that violate these Terms, are inactive for extended periods, or were created fraudulently.

4. Content You Upload

Ownership and License

You retain ownership of photographs you upload. By uploading content to RichmondPix, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your photos on the Platform and in Platform-related marketing materials (social media, blog posts, press). This license ends when you delete the photo or your account.

Your Responsibility

You represent and warrant that:

• You took the photo or have the legal right to upload and share it
• Your content does not infringe any copyright, trademark, or other intellectual property right
• You have obtained any necessary consent from identifiable people depicted in your photos
• Your content does not violate any law or these Terms

Prohibited Content

You may not upload content that:

• Is illegal, obscene, or sexually explicit
• Depicts minors in an inappropriate manner
• Harasses, threatens, or defames any person
• Infringes a third party's copyright or other rights
• Contains malware, spam, or deceptive material
• Is not a genuine photograph of a Richmond, Virginia subject

5. Community Standards

RichmondPix is a community platform. You agree to interact respectfully with other members. Harassment, hate speech, spamming other users, or any conduct that damages the community experience may result in account suspension or termination at our sole discretion.

6. Content Moderation

All uploaded photos are subject to review before appearing on the Platform. We may approve, reject, or remove any content at our discretion, with or without notice. Removal of content does not constitute a breach of these Terms by us.

7. Copyright and DMCA

If you believe your copyrighted work has been uploaded to RichmondPix without authorization, send a written notice to hello@richmondpix.com including: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Platform; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury. We will respond promptly to valid DMCA notices.

8. Platform Use Restrictions

You may not:

• Scrape, crawl, or systematically download Platform content without written permission
• Attempt to circumvent any security or access controls
• Use the Platform to distribute unsolicited commercial messages
• Impersonate another person or entity
• Use automated tools to create fake accounts or manipulate engagement metrics
• Interfere with the Platform's operation or servers

9. Intellectual Property

The RichmondPix name, logo, design, and original Platform content (excluding user-uploaded photos) are owned by RichmondPix and protected by copyright and trademark law. You may not use our branding without written permission.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. User-uploaded content reflects the views of individual contributors, not RichmondPix.

11. Limitation of Liability

To the fullest extent permitted by law, RichmondPix and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including lost data, lost profits, or damages resulting from user-generated content. Our total liability to you for any claim shall not exceed $100 USD.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Richmond, Virginia.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on the Platform or by email. Continued use after changes constitutes acceptance of the updated Terms.
